Terms of Service

1. Acceptance of Terms
By accessing or using the EZ Pool Biller App (the “App”), you and the company you represent (“Subscriber”) agree to be bound by these Terms of Service. This App is designed as a companion tool for the EZ Pool Biller Software. If you do not agree to these terms, you may not use the App.
 
2. Nature of Service
The App is a data-collection tool that allows users to capture images, location/time/date stamps, and chemical readings, which are then transmitted to the main EZ Pool Biller Software. The App is provided for professional use only by employees or contractors of registered Subscribers.
 
3. No Responsibility for Data Accuracy
EZ Pool Biller provides the platform, not the expertise.
  • Chemical Readings: You acknowledge that any chemical readings, measurements, or data entries recorded in the App are performed by the user. EZ Pool Biller does not verify, calibrate, or guarantee the accuracy of this data. We are not liable for any property damage, pool equipment failure, or health issues resulting from incorrect chemical applications based on data entered through the App.
  • Billing and Customer Disputes: The App facilitates the transmission of data for billing purposes and ensuring work performance. EZ Pool Biller is not a party to any agreement between the Subscriber and their customers. We are not responsible for any billing errors, lost revenue, or disputes arising from the information (or lack thereof) submitted through the App.
 
4. Ownership of Submitted Data
All data submitted through the App (images, readings, etc.) becomes the property of the Subscriber account holder. EZ Pool Biller acts as a processor for this information. The Subscriber is responsible for ensuring they have the necessary rights and permissions from their customers to capture and transmit this data.
 
5. Disclaimer of Warranties
The App is provided on an “AS IS” and “AS AVAILABLE” basis. While we strive for 100% uptime, we do not guarantee that the App will be uninterrupted or error-free. We are not responsible for data loss due to poor cellular connectivity, hardware failure, or synchronization errors.
 
6. Limitation of Liability
To the maximum extent permitted by law, EZ Pool Biller and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or equipment damage, arising out of the use or inability to use the App.
 
7. Account Security
Users are responsible for maintaining the confidentiality of their login credentials. Any activity occurring under a user’s account is the responsibility of the Subscriber.
 
8. Changes to Terms
We reserve the right to modify these terms at any time. Your continued use of the App following the posting of changes constitutes acceptance of those changes.
